These Terms of Service ("Terms") govern your access to and use of findmyprovider.com.au (the "Site"), operated by findmyprovider ("we", "us", "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About findmyprovider

findmyprovider is an online directory connecting NDIS participants, families and support coordinators with registered and unregistered NDIS providers across Australia. The Site combines publicly-available data from the NDIS Provider Register, third-party business listings, and information submitted by providers themselves.

We are an independent service. We are not affiliated with, endorsed by, or in any way officially connected with the National Disability Insurance Scheme (NDIS), the National Disability Insurance Agency (NDIA), or any Australian Government department or agency.

2. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

  • Use the Site to violate any applicable law or regulation
  • Impersonate any person or entity
  • Submit false, misleading, or fraudulent information
  • Scrape, harvest or extract data from the Site without our prior written consent
  • Interfere with or disrupt the Site, its servers, or networks
  • Attempt to gain unauthorised access to any part of the Site
  • Use automated tools (bots, spiders) to access the Site, except for legitimate search engine indexing

3. Provider Accounts and Profiles

If you create a provider account:

  • You must provide accurate, current information including a valid Australian Business Number (ABN)
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activity that occurs under your account
  • You may only create a profile for a business you legally represent
  • We may suspend or terminate accounts that breach these Terms or contain false information

Profile content (organisation name, About section, logo, contact details, categories) must be:

  • Accurate and not misleading
  • Free from offensive, discriminatory, or unlawful content
  • Owned by you or used with the relevant permission

We reserve the right to remove or modify profile content that breaches these Terms.

4. Sponsored Listings

Sponsorship is a paid feature that places your provider profile at the top of search results in your selected Local Government Areas (LGAs).

  • Pricing is published on the Site and displayed before checkout. Prices may change with reasonable notice.
  • Sponsorship is billed monthly via Stripe. All prices are in Australian dollars and inclusive of GST where applicable.
  • Auto-renewing sponsorships continue until you cancel them. One-off sponsorships expire after 30 days.
  • Refunds are not generally provided for unused portions of a billing period, except where required by Australian Consumer Law.
  • We reserve the right to refuse, suspend or refund any sponsorship that breaches these Terms.

5. Information Accuracy and No Endorsement

The Site aggregates information from multiple sources. While we make reasonable efforts to keep information accurate, we make no warranty about the accuracy, completeness, or currency of any provider listing, NDIS registration status, contact details, or other content.

Listing on the Site is not an endorsement, recommendation, or vetting of any provider's services, qualifications, or fitness for any purpose. You should independently verify a provider's credentials, NDIS registration status, insurance, and suitability for your needs before engaging their services.

The Site does not provide medical, legal, financial, or NDIS planning advice. Information on the Site should not be relied upon as a substitute for professional advice.

6. Intellectual Property

The Site — including its design, code, original content, and trademarks — is owned by findmyprovider and protected by Australian and international intellectual property laws.

By submitting content to the Site (provider profiles, logos, About sections, contact form messages), you grant us a non-exclusive, worldwide, royalty-free licence to use, display, store, and distribute that content on the Site for the purpose of operating the directory.

7. Disclaimer of Warranties

The Site is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, findmyprovider, its operators and contributors will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of the Site, including but not limited to:

  • Reliance on any provider listing or information shown on the Site
  • Any interaction or transaction with a provider listed on the Site
  • Inability to access the Site
  • Loss of data, profits, or goodwill

Nothing in these Terms excludes or limits any guarantee, warranty, condition or right that cannot lawfully be excluded or limited under the Australian Consumer Law.

9. Indemnification

You agree to indemnify and hold harmless findmyprovider, its operators and contributors from any claim, demand, loss, or damage (including reasonable legal fees) arising out of:

  • Your breach of these Terms
  • Your use of the Site
  • Content you submit to the Site
  • Your interaction with any provider listed on the Site

10. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any breach of these Terms or for any other reason at our discretion. You may close your account at any time by contacting us.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the Site or by email to registered users. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of New South Wales.
